La consultation ou l'utilisation du Blog https://www.vox-populi.com (ci-après le Blog), créé et géré par la SA JPCR implique automatiquement la pleine acceptation des conditions générales d’utilisation et de la privacy policy ci-dessous. L'accès aux informations que contient ce Blog est gratuit, mais il implique la prise de connaissance et l'acceptation des conditions reprises ci-dessous.

Si vous nous contactez pour rejoindre notre panel de consommateurs, cela signifie que vous, (ci-après l’utilisateur), avez accepté formellement les conditions reprises ci-dessous.

1.6 Propriété intellectuelle et industrielle du contenu du Blog

Les textes, photos, mises en pages, lay-out, slogans, illustrations et autres éléments figurant sur le Blog sont protégés par le droit d'auteur et sont la propriété de JPCR SA ou de ses clients. Les dénominations JPCR, BIG ™, VOX POPULI™, ITIS™, leurs logos, dessins, slogans, bases de données sont protégés par le droit de la propriété intellectuelle et industrielle. Toute copie, adaptation, traduction, arrangement, utilisation ou modification de tout ou partie de ce Blog, sous quelque forme et par quelque moyen que ce soit est strictement interdite sans l'autorisation préalable et écrite de JPCR SA. Les utilisateurs du Blog s'engagent expressément à respecter intégralement les droits d'auteurs appartenant à JPCR SA et à des tiers. JPCR SA se réserve le droit de prendre toutes les mesures qu'elle jugera adéquates afin d'empêcher ou de mettre un terme à l'atteinte à ses droits d'auteurs, sans qu'aucune responsabilité ne puisse lui être imputée en raison de ces mesures.

JPCR SA autorise uniquement l’utilisateur à copier, imprimer et utiliser les données du Blog à la seule condition qu'elles soient affectées à l’information du visiteur et à l’exclusion d'une quelconque multiplication, distribution, ou commercialisation. Toute infraction aux droits intellectuels de JPCR SA peut donner lieu à des poursuites civiles et pénales

1.7 Cession de droits de propriété intellectuelle

L’utilisateur cède de façon intégrale, définitive et exclusive à JPCR SA tous les droits de propriété industrielle ou intellectuelle, tous les droits d'auteur et droits voisins sur les travaux, préparations, études, recherches, expériences, inventions, feedback de données, réponses à des questions ou autres (ci-après « les travaux »), faits ou exécutés à l'occasion ou dans le cadre de l’étude de marché, seul ou en collaboration avec d’autres, dès l'instant où naissent lesdits droits, et ce de la façon la plus complète qui soit, et ce sur tous supports digitaux ou autres, pouvant être utilisés par JPCR SA en l’état ou intégrés, avec ou sans modification, pour toute forme ou tout mode d'exploitation, pour toute la durée du droit concerné et dans le monde entier.

Les droits cédés sont : les droits de reproduction sur tout support, de représentation, de communication au public, de diffusion directe ou par satellite, par Internet, par câble, par réseau hertzien, ou par toute autre technique ainsi que les droits de correction, d’évolution, de suivi, d’utilisation, de maintenance, d’adaptation, de traduction, de commercialisation, d’édition, de transcription, d’exploitation et de développement.

L’utilisateur s'engage à apporter à JPCR SA tout le concours utile à l'obtention et au maintien de tout droit ou titre juridique concernant les œuvres objet de la cession, notamment par la signature des documents utiles et sa participation aux procédures d'obtention dudit droit ou dudit titre.

L’utilisateur garantit qu’il détient tous les droits d’auteur et voisins sur les œuvres protégées par le droit de la propriété intellectuelle qu’il pourra réaliser dans le cadre des présentes et garantit à JPCR SA la jouissance entière et libre des droits cédés contre tout trouble et éviction quelconque. L’utilisateur ne pourra dans le cadre du Blog utiliser aucune œuvre protégée dont ni lui ni JPCR SA ne détiendrait les droits ou dont il n’aurait pas acquis les droits pour JPCR SA, sans en avertir préalablement celle-ci et en avoir obtenu une autorisation expresse.

Seule JPCR SA et son client ont le droit d'établir si, quand et de quelle manière l'œuvre sera exploitée. L'œuvre même non exploitée demeurera la propriété exclusive de JPCR SA.

JPCR SA est autorisée à ne pas mentionner le nom de l’utilisateur visiteur, à utiliser une œuvre même considérée comme non finalisée par celui-ci, ainsi qu'à modifier l'œuvre dans toute la mesure qu'elle jugera nécessaire à l'exploitation de l'œuvre, sans préjudice au droit de l’utilisateur visiteur de s'opposer à toute altération, mutilation, modification ou atteinte à ladite œuvre qui serait préjudiciable à son honneur ou à sa réputation.

Cette cession entre dans le cadre des lois belges sur la propriété intellectuelle et industrielle. Elle est conclue de façon définitive. Au terme de cette cession, l’utilisateur n’a plus aucun droit sur les éléments cédés, et ce tant en Belgique qu’à l’étranger.

1.8 Cession de droit à l’image

L’utilisateur autorise JPCR SA à utiliser, reproduire et communiquer les images fixes et/ou séquences vidéo de lui-même et ou d’autres personnes physiques dont il aura obtenu une autorisation écrite identique au présent paragraphe, qu’il postera sur le Blog (ci-après les “Images”) , en tout ou en partie, intégrées ou non avec d’autres images fixes ou animées, modifiées, retouchées ou non, en édition sur tout support papier, textile, plastique, ou autres, en diffusion sur tout support vidéo digital ou non, et en intégration sur tout support électronique y compris l’internet et l’intranet, et ce, sans limitation de durée à compter de la signature de la présente.

Cette autorisation est accordée pour toute zone de diffusion tant en Belgique qu’à l’étranger pour toute communication interne et externe tant pour JPCR SA que pour ses clients, et notamment (sans que cette énumération soit limitative) la presse interne d’entreprise, toute plaquette institutionnelle ou rapport annuel
pour toute utilisation publicitaire (donnant lieu à de l’achat d’espace publicitaire dans tous supports externes ou sur tous supports publicitaires ou commerciaux, packaging, édition, presse, design, marketing direct, etc.) réalisée par JPCR ou par ses clients

Cette autorisation est valable pour une période de 5 ans à compter de la date de signature de la présente et pourra être prolongée. JPCR SA s’engage à respecter la réglementation concernant le droit au respect des données personnelles dans le cadre des finalités de cette autorisation. La politique de vie privée de JPCR SA se trouve ci-dessous

L’utilisateur renonce expressément à toute rétribution de quelque nature que ce soit concernant l’utilisation des Images pour les usages prévus dans la présente autorisation. L’utilisateur certifie disposer pleinement des droits cédés, en ce compris toute autorisation de tiers, comprends et accepte que la présente autorisation n’oblige nullement JPCR SA à utiliser les Images.

Un retrait de la présente autorisation ne pourra être obtenu que moyennant l’envoi par le soussigné d’un courrier recommandé adressé à la direction de JPCR SA. Le retrait de l’autorisation ne sera effectif, en tout état de cause, qu’au plus tôt 6 mois après la réception du courrier et ce retrait ne concernera pas les utilisations des images sur des supports existants ou en voie de réalisation à la date de la réception du courrier et ce, pour toute la durée de vie de ces supports.

1.9 Responsabilité de l’utilisateur

En accédant aux informations proposées par le site, et en participant aux études de marché, l'utilisateur renonce à toute réclamation ou recours quel qu'il soit contre JPCR SA concernant l'usage des données ou des informations mises à sa disposition sur le Blog. La responsabilité de JPCR SA ne pourra en aucun cas être engagée en cas de dommage de quelque nature que ce soit, qu'il soit consécutif ou fortuit.

De même, en accédant aux informations proposées par le Blog, l'utilisateur accepte d'assumer tous les risques inhérents à l'utilisation de celui-ci et de renoncer à toute réclamation contre JPCR SA, en ce compris le risque de dommages causés à un ordinateur, à un logiciel ou aux données par un virus qui serait transmis ou activé par le Blog ou par le fait que l’utilisateur y accède.

En cas de participation à des études proposées par JPCR SA, une rémunération et/ou un défraiement pourra être versé à l’utilisateur. L’utilisateur devra, dans les cas prévus par la règlementation fiscale et sociale, prendre en charge la déclaration de ces revenus dans sa déclaration fiscale et s’engage, si nécessaire, à prendre le statut fiscal et/ou social nécessaire. Si l’utilisateur dispose d’un statut de travailleur indépendant, ou exerce son activité en société, il devra prévenir JPCR SA préalablement à l’étude.

JPCR SA déclarera effectuera les déclarations fiscales et sociales imposées par la loi pour ce qui concerne les versements aux utilisateurs, ce qu’ils acceptent expressément par leur acceptation des présentes conditions générales.

1.10 Sécurité du site

Pour assurer la sécurité de son site, JPCR SA prendra toutes les mesures nécessaires telles que des audits de sécurité, des techniques d’encryptions, des environnements sécurisés et toutes les mesures et procédures raisonnables selon l’état de l’art en la matière. Certaines zones du Blog pourront réservées et liées à des modalités d’accès. En cas d’attaque du site, de criminalité informatique, ou de toute autre tentative non autorisée d’accéder à tout ou partie du site, JPCR SA utilisera tous les moyens légaux mis à sa disposition pour préserver l’intégrité de son Blog et ce en collaboration avec les autorités judiciaires et policières compétentes.

1.11 Droit applicable et tribunaux compétents

Votre visite du Blog impliquant votre accord sur les présentes conditions d’utilisation et constituant donc un accord on line, vous acceptez que toute contestation ou action relative au présent Blog ou à toute donnée figurant sur celui-ci, sont régis par le droit belge. En consultant le site, vous reconnaissez la compétence des cours et tribunaux de Nivelles, Belgique siégeant en langue française, et vous acceptez de n'engager des actions que devant ces juridictions.

Aucun marketing direct ne sera réalisé sur la base des données personnelles que vous nous avez confiées. Si nous souhaitions utiliser vos données personnelles pour une finalité nouvelle, nous vous contacterons et nous vous demanderions votre consentement préalablement à cette nouvelle utilisation.

La présente politique de vie privée ne peut pas restreindre les droits que JPCR SA pourrait détenir à l’égard de toute personne physique en vertu de contrats ou d’une autre législation.

2.8 Divulgation des données à des tiers

Nous ne divulguons vos données personnelles à aucun tiers. Nous nous réservons uniquement le droit de transmettre des données personnelles sur la requête d’une autorité judiciaire ou administrative en vertu de la loi.

Notre client aura accès aux réponses et commentaires sur le Blog, mais les données personnelles des auteurs des réponses et commentaires ne lui seront en aucun cas accessibles.

2.9 Durée de conservation des données

Les données collectées sont conservées pour la seule durée de l’étude de marché, et la période de conservation des données nécessaire postérieurement à celle-ci en vertu d’obligations légales ou contractuelles.

En l’absence d’obligation légales les données des participants seront conservées durant 10 ans après leur dernière participation à une étude de marché ou dix ans après leur inscription s’ils n’ont jamais participé à une étude.

2.10 Confidentialité et sécurité

JPCR SA ne donne pas la possibilité aux visiteurs du Blog d'utiliser une méthode de transmission sécurisée pour envoyer des données personnelles.

Le Blog obéit à une politique, à des règles et à des mesures de sécurité visant à protéger les données personnelles.

Compte étant tenu des techniques les plus récentes et des coûts liés à leur mise en œuvre, JPCR SA applique, tant lors de la définition des moyens de traitement que lors du traitement proprement dit, les mesures et procédures techniques et organisationnelles appropriées de manière à ce que le traitement soit conforme aux prescriptions légales et garantisse la protection des droits de la personne concernée.

JPCR SA met en œuvre des mécanismes visant à garantir que, par défaut, seules seront traitées les données à caractère personnel nécessaires à chaque finalité spécifique du traitement, ces données n'étant, en particulier, pas collectées ou conservées au-delà du minimum nécessaire à ces finalités, pour ce qui est tant de la quantité de données que de la durée de leur conservation. En particulier, ces mécanismes garantissent que, par défaut, les données à caractère personnel ne sont pas rendues accessibles à un nombre indéterminé de personnes physiques.

JPCR SA et tout sous-traitant mettent en œuvre les mesures techniques et organisationnelles appropriées afin de garantir, compte étant tenu des techniques les plus récentes et des coûts liés à leur mise en œuvre, un niveau de sécurité adapté aux risques présentés par le traitement et à la nature des données à caractère personnel à protéger.

À la suite d'une évaluation des risques, JPCR SA et le sous-traitant prennent les mesures prévues par la réglementation pour protéger les données à caractère personnel contre la destruction accidentelle ou illicite et la perte accidentelle et pour empêcher toute forme illicite de traitement, notamment la divulgation, la diffusion ou l'accès non autorisés, ou l'altération de données à caractère personnel.

JPCR SA :

fera toute diligence pour tenir les données à jour, pour rectifier ou supprimer les données inexactes, incomplètes, ou non pertinentes ;
veillera à ce que, pour les personnes agissant sous son autorité, l'accès aux données et les possibilités de traitement soient limités à ce dont ces personnes ont besoin pour l'exercice de leurs fonctions ou à ce qui est nécessaire pour les nécessités du service ;
informera les personnes agissant sous son autorité des dispositions de la loi belge et de ses arrêtés d'exécution, ainsi que de toute prescription pertinente, relative à la protection de la vie privée à l'égard des traitements des données à caractère personnel;
s'assurera de la conformité des programmes servant au traitement automatisé des données à caractère personnel avec les termes de la déclaration à la Commission de la vie privée ainsi que de la régularité de leur application ;
s’assurera que toute personne agissant sous l'autorité du responsable du traitement ou de celle d’un sous-traitant, ainsi que le sous-traitant lui-même, qui accède à des données à caractère personnel, ne puisse les traiter que sur instruction du responsable du traitement, sauf en cas d'une obligation imposée par ou en vertu d'une loi, d'un décret ou d'une ordonnance.
Prendra, et obligera ses sous-traitants et partenaires à prendre les mesures techniques et organisationnelles requises pour protéger les données à caractère personnel contre la destruction accidentelle ou non autorisée, contre la perte accidentelle ainsi que contre la modification, l'accès et tout autre traitement non autorisé de données à caractère personnel. Ces mesures assureront un niveau de protection adéquat, compte tenu, d'une part, de l'état de la technique en la matière et des frais qu'entraîne l'application de ces mesures et, d'autre part, de la nature des données à protéger et des risques potentiels.

Lorsque le traitement de données est confié à un sous-traitant, JPCR SA :

choisira un sous-traitant qui apporte des garanties suffisantes au regard des mesures de sécurité technique et d'organisation relatives aux traitements;
veillera au respect de ces mesures notamment par la stipulation de mentions contractuelles;
fixera dans le contrat la responsabilité du sous-traitant à l'égard du responsable du traitement;
conviendra avec le sous-traitant que celui-ci n'agit que sur la seule instruction du responsable du traitement et est tenu par les mêmes obligations que celles auxquelles le responsable du traitement est tenu en application de la loi ;
consignera par écrit ou sur un support électronique les éléments du contrat relatifs à la protection des données et les exigences portant sur les mesures de sécurité ;

1 Algemene voorwaarden voor gebruik van Vox Populi

1.1 Toegang tot de blog

De raadpleging of het gebruik van de blog https://www.vox-populi.com (verder “de blog”), gecreëerd en beheerd door de nv JPCR, impliceert automatisch de aanvaarding van de algemene gebruiksvoorwaarden en de onderstaande privacy. De toegang tot de informatie op deze blog is gratis, maar impliceert de kennisname en aanvaarding van onderstaande voorwaarden.

Het feit dat u contact met ons opneemt om aan te sluiten bij ons consumentenpanel, houdt in dat u (verder “de gebruiker”) uitdrukkelijk instemt met de onderstaande voorwaarden.

1.2 Privacy

 Het privacybeleid van de blog is verder toegankelijk.

1.3 Informatie die de blog voorstelt

JPCR nv beheert en werkt deze blog permanent bij om de bezoekers de meest recente informatie te verstrekken. Deze blog wil de bezoekers zo goed mogelijk informeren. JPCR nv zal alles in het werk stellen om eventuele verkeerde informatie te verbeteren zodra deze wordt ontdekt. JPCR nv kan niet aansprakelijk worden gesteld voor de juistheid of de uitgebreidheid van de informatie die op deze blog wordt geraadpleegd.

De informatie die op de blog wordt gepubliceerd, is van algemene aard en niet ontworpen om in te spelen op een individuele behoefte, is niet noodzakelijk compleet of bijgewerkt en vormt geen advies of professionele aanbeveling.

De inhoud van de blog (inclusief de hyperlinks) kan op elk moment worden aangepast, gewijzigd of aangevuld zonder waarschuwing of mededeling.

JPCR nv wijst alle aansprakelijkheid af bij ongepast of frauduleus gebruik van de gegevens op de blog.

JPCR nv kan in geen geval aansprakelijk worden gesteld voor de inhoud van de blog of het rechtstreekse of onrechtstreekse gebruik dat ervan gemaakt kan worden. JPCR nv garandeert in geen geval de juistheid van de informatie op zijn blog of van deze die via zijn blog toegankelijk zijn en behoudt zich het recht voor om willekeurige commentaar die op de blog wordt gepost, te wissen of informatie te wijzigen zonder voorafgaandelijke kennisgeving.

1.4 Hyperlinks naar deze site

De creatie van links naar de blog moet aan de administrator van deze site worden meegedeeld. De link moet zo worden gecreëerd dat er een nieuw venster opent op de browser, die enkel de home page van de site voorstelt. Onderliggende links (deep linking) zijn verboden.

1.5 Hyperlinks naar andere sites

De blog kan hyperlinks bevatten naar sites van andere instellingen die verbonden zijn met JPCR nv of die volledig onafhankelijk zijn. JPCR nv is in geen geval aansprakelijk voor de inhoud of het privacybeleid van een site waarnaar een link op de blog verwijst.

De hyperlinks naar een of meerdere andere sites, inclusief de links in die sites, betekenen in geen geval het bestaan van een vereniging, partnerschap, lidmaatschap of instemming met de instellingen die deze sites aanbieden.

Zodra JPCR nv verneemt dat een blog waarnaar een link op deze blog verwijst, een illegale inhoud heeft of niet overeenstemt met het beoogde doel, wordt de hyperlink van de blog verwijderd, zonder dat JPCR nv aansprakelijk kan worden gesteld voor de periode waarin de hyperlink op de blog werd aangeboden.

1.6 Intellectuele en industriële eigendom van de inhoud van de blog

De teksten, foto’s, opmaak, lay-out, slogans, illustraties en andere elementen op de blog worden beschermd door het auteursrecht en zijn eigendom van JPCR nv of zijn klanten. De namen JPCR, BIG™, VOX POPULI™, ITIS™, hun logo’s, tekeningen, slogans, gegevensbestanden worden beschermd door het intellectuele en industriële eigendomsrecht. Elke totale of gedeeltelijke kopie, aanpassing, vertaling, arrangement, gebruik of wijziging van deze blog, onder welke vorm en door welk middel ook, is strikt verboden zonder de voorafgaande schriftelijke toelating van JPCR nv. De gebruikers van de blog verbinden er zich uitdrukkelijk toe om de auteursrechten van JPCR nv en derden integraal te respecteren. JPCR nv behoudt zich het recht voor alle maatregelen te treffen die hij nodig acht om inbreuken op deze auteursrechten te vermijden of te beëindigen, zonder dat hij aansprakelijk kan worden gesteld omwille van deze maatregelen.

JPCR nv laat de gebruiker enkel toe om gegevens van de blog te kopiëren, te printen en te gebruiken indien ze bestemd zijn om de bezoeker te informeren en met uitzondering van een willekeurige vermenigvuldiging, verdeling of commercialisering.Elke inbreuk op de intellectuele rechten van JPCR nv kan aanleiding geven tot burgerlijke of strafrechtelijke vervolging.

1.7 Overdracht van de intellectuele eigendomsrechten

De gebruiker draagt alle intellectuele en industriële eigendomsrechten, auteursrechten en naburige rechten op de werken, voorbereidingen, studies, onderzoeken, experimenten, uitvindingen, feedback van gegevens, antwoorden op vragen of andere (verder “de werken”), gemaakt of uitgevoerd naar aanleiding van of in het kader van de marktstudie, alleen of in samenwerking met anderen volledig, definitief en exclusief over aan JPCR nv vanaf het moment waarop deze rechten ontstaan, op de meest volledige manier en op alle digitale of andere dragers die JPCR nv los of geïntegreerd kan gebruiken, met of zonder wijziging, voor elke exploitatievorm of -wijze, voor de volledige duur van het betrokken recht en wereldwijd.

De overgedragen rechten zijn: de rechten van reproductie op willekeurige dragers, van vertegenwoordiging, van mededeling aan het publiek, van rechtstreekse verzending of per satelliet, internet, kabel, hertz of willekeurige andere techniek, alsook de rechten op correctie, evolutie, opvolging, gebruik, maintenance, aanpassing, vertaling, commercialisering, editie, transcriptie, exploitatie en ontwikkeling.

De gebruiker verbindt er zich toe om JPCR nv te helpen bij het krijgen en behouden van elk recht of willekeurige juridische titel op de voorwerpen, onderwerp van de overdracht, meer bepaald door de vereiste documenten te ondertekenen en mee te werken aan de aanvraagprocedures van dergelijk recht of titel.

De gebruiker garandeert dat hij alle auteursrechten en naburige rechten bezit op de werken die door het intellectuele eigendomsrecht worden beschermd en dat hij zou kunnen uitoefenen in het kader van onderhavige en garandeert JPCR nv het volledige en vrije genot van de overgedragen rechten tegen willekeurige genotsderving en uitwinning. De gebruiker mag in het kader van de blog geen beschermde werken gebruiken waarvan noch hij, noch JPCR nv de rechten zouden hebben of waarvan hij de rechten niet gekocht heeft voor JPCR nv, zonder deze laatste voorafgaand te waarschuwen en een uitdrukkelijke toelating te hebben gekregen.

Enkel JPCR nv en zijn klant hebben het recht om te bepalen of, wanneer en hoe het werk wordt uitgebaat. Het werk blijft de exclusieve eigendom van JPCR nv, ook wanneer het niet uitgebaat wordt.

JPCR nv is gemachtigd om de naam van de gebruiker niet te vermelden, om een werk te gebruiken dat deze als onafgewerkt beschouwd, alsook om het werk te wijzigen indien hij dat nodig acht voor de exploitatie van het werk, onverminderd het recht van de gebruiker om zich te verzetten tegen willekeurige verbouwing, verminking, wijziging of beschadiging van het werk dat schadelijk zou zijn voor zijn eer of zijn reputatie.

Deze overdracht kadert in de Belgische wetten op de intellectuele en industriële eigendom. Ze is definitief. Krachtens deze overdracht heeft de gebruiker geen enkel recht meer op de overgedragen elementen, noch in België, noch in het buitenland.

1.8 Overdracht van het recht op afbeelding

De gebruiker geeft JPCR nv toelating om de vaste beelden en/of videobeelden van zichzelf of andere natuurlijke personen van wie hij een schriftelijke toelating gekregen heeft zoals in deze paragraaf, die hij op de blog post (verder de “beelden”), in hun geheel of gedeeltelijk te gebruiken, te reproduceren en te communiceren, al dan niet samen met andere vaste of geanimeerde beelden, gewijzigd, al dan niet verbeterd, op willekeurige drager van papier, textiel, plastic of andere, verspreid op al dan niet digitale videodragers en geïntegreerd op willekeurige elektronische dragers met inbegrip van het internet en het intranet en dit, zonder beperking qua duur vanaf de ondertekening van onderhavige.

Deze toelating wordt gegeven voor willekeurige uitzendingsgebieden in België en het buitenland, voor willekeurige interne en externe communicatie, zowel voor JPCR nv als voor zijn klanten en meer bepaald (zonder dat deze opsomming beperkend is) de interne bedrijfskrant, willekeurige institutionele folders of jaarverslagen,
voor willekeurig publicitair gebruik (dat aanleiding geeft tot de aankoop van reclameruimte in externe dragers of willekeurige publicitaire of commerciële dragers, packaging, editie, pers, design, direct marketing, enz.), door JPCR nv of zijn klanten.

Deze toelating is geldig voor een periode van 5 jaar vanaf de datum van ondertekening van onderhavige en kan worden verlengd. JPCR nv verbindt zich ertoe om de regelgeving op het recht op privacy na te leven in het kader van de doeleinden van deze toelating. Het privacybeleid van JPCR nv wordt verder weergegeven.

De gebruiker ziet uitdrukkelijk af van een willekeurige vergoeding voor het gebruik van de beelden voor de in deze toelating vermelde doeleinden. De gebruiker bevestigt dat hij volledig over de overgedragen rechten beschikt, inclusief willekeurige toelatingen van derden, dat hij begrijpt en aanvaardt dat deze toelating JPCR nv geenszins verplicht om de beelden te gebruiken.

De gebruiker kan deze toelating enkel per aangetekende brief aan de directie van JPCR nv intrekken. Deze intrekking zal in elk geval ten vroegste 6 maand na ontvangst van de brief van kracht zijn en deze intrekking geldt niet voor het gebruik van beelden op bestaande dragers of die worden gerealiseerd op de datum van ontvangst van deze brief en dit, voor de volledige levensduur van deze dragers.

1.9 Aansprakelijkheid van de gebruiker

Door de gegevens op de site te raadplegen en deel te nemen aan marktstudies, ziet de gebruiker af van willekeurige klachten of beroepen tegen JPCR nv wat betreft het gebruik van de gegevens of informatie die tot zijn beschikking worden gesteld op de blog. JPCR nv kan in geen geval aansprakelijk worden gesteld bij schade van welke aard ook, ongeacht of de gevolgschade of toevallige schade is.

Door de informatie op de blog te raadplegen, aanvaardt de gebruiker de aansprakelijkheid voor alle risico’s die inherent zijn aan het gebruik ervan en ziet af van willekeurige klachten tegen JPCR nv, inclusief het risico op schade aan een computer, software of gegevens door een virus dat zou worden gecommuniceerd of geactiveerd door de blog of het feit dat de gebruiker deze raadpleegt.

Bij deelname aan studies die JPCR nv voorstelt, kan een bezoldiging en/of vergoeding worden uitgekeerd aan de gebruiker. In de gevallen waarin de fiscale en sociale reglementering het eist, moet de gebruiker deze inkomsten vermelden in zijn belastingaangifte en indien nodig, het vereiste fiscale en/of sociale statuut aanvragen. Indien de gebruiker het zelfstandigenstatuut heeft of in het kader van een vennootschap werkt, moet hij JPCR nv voor de studie inlichten.

JPCR nv doet de wettelijk vereiste fiscale en sociale aangiften van de stortingen aan de gebruikers, wat deze uitdrukkelijk aanvaarden door onderhavige algemene voorwaarden te aanvaarden.

1.10 Veiligheid van de site

JPCR nv neemt alle vereiste maatregelen om de veiligheid van de site te garanderen, zoals veiligheidsaudits, versleutelingstechnieken, beveiligde omgevingen en alle redelijke maatregelen en procedures volgens de regels van de kunst in de materie. Sommige zones van de blog kunnen gereserveerd zijn en gekoppeld aan toegangsmodaliteiten. Bij aanval op de site, computercriminaliteit of elke andere ongeoorloofde poging om toegang te krijgen tot een deel of de volledige site, zal JPCR nv alle wettelijke middelen gebruiken om de integriteit van zijn blog te handhaven en dit, in samenwerking met de bevoegde gerechtelijke en politiediensten.

1.11 Toepasselijk recht en bevoegde rechtbanken

Uw bezoek aan de blog impliceert uw akkoord met onderhavige gebruiksvoorwaarden en vermits het om een online-akkoord gaat, stemt u ermee in dat elke betwisting of elke vordering betreffende deze blog of gegevens op deze blog, door het Belgisch recht wordt geregeld. Door de site te bezoeken erkent u de bevoegdheid van de hoven en rechtbanken van Nijvel, België, zetelend in de Franse taal en stemt u ermee in om enkel vorderingen in te stellen bij deze rechtsmachten.

2 Privacybeleid

2.1 Identificatie van de blog en de verantwoordelijke organisatie

Moderne informatie- en communicatietechnologieën spelen een fundamentele rol in de activiteiten van een organisatie zoals JPCR nv. Onze hoofdactiviteiten bestaan uit de uitvoering van kwalitatieve marktstudies voor onze klanten.

JPCR nv verbindt zich ertoe om de Belgische wetgeving op de bescherming van de persoonsgegevens nauwgezet na te leven. Deze wetgeving staat integraal op de website van de Gegevensbeschermingsautoriteit

2.2 Anonieme toegang en aanvaarding van ons privacybeleid

U moet geen persoonsgegevens meedelen om toegang te krijgen tot onze home page en onze blog.

Met het gebruik van onze blog, door aan te sluiten bij ons consumentenpanel, verklaart u expliciet dat u het privacybeleid van de blog aanvaardt en stemt u ermee in dat we persoonsgegevens inzamelen en verwerken volgens de modaliteiten en principes van onderhavig beleid.

2.3 Diensten en interactiviteit van onze blog

Met onze blog, die in het geval van bepaalde studies is voorbehouden aan erkende gebruikers, kunnen bezoekers met elkaar communiceren en informatie publiceren die toegankelijk is voor andere surfers.

2.4 Register van verwerkingen

JPCR nv heeft een register aangelegd van alle verwerkingen die onder haar aansprakelijkheid worden uitgevoerd. De documentatie bevat op zijn minst onderstaande informatie:

de naam en de gegevens van de verantwoordelijke voor de verwerking of een adjunct-verantwoordelijke voor de verwerking of een onderaannemer en de vertegenwoordiger in voorkomend geval;
de naam en de gegevens van de verantwoordelijke persoon of functionaris voor gegevensbescherming;
de doeleinden van de verwerking;
een beschrijving van de betrokken categorieën personen en categorieën persoonsgegevens in verband hiermee;
de ontvangers of de categorieën ontvangers van persoonsgegevens, inclusief de verantwoordelijken voor de verwerking aan wie de persoonsgegevens worden meegedeeld in het kader van een gerechtvaardigd belang;
desgevallend de transfer van gegevens naar een derde land of een internationale organisatie, inclusief de naam van dit derde land of deze internationale organisatie en, in voorkomend geval, de documenten die het bestaan van gepaste waarborgen aantonen;
een algemene aanwijzing voor de termijnen waarin de verschillende categorieën gegevens moeten worden gewist.

2.5 Automatische inzameling van informatie

Net als bij elk bezoek aan een blog wordt de volgende informatie ingezameld:

Pagina vóór de aankomst op de blog

JPCR nv zamelt deze gegevens enkel in voor de bezoekersstatistieken van de blog en koppelt deze niet aan persoonsgegevens die ergens anders werden ingezameld.

2.6 Cookies

Tijdens uw bezoek aan onze blog kan een “cookie” worden geregistreerd op uw harde schijf (klein bestand dat wordt meegezonden door een internetserver, die zich op de harde schijf van uw computer registreert en een spoor en bepaalde informatie van het bezoek bewaart, die enkel toegankelijk zijn voor deze blog).

U kunt uw internetbrowser zodanig instellen zodat u over het bestaan van de cookies wordt ingelicht of ze systematisch weigeren. Deze cookie vergemakkelijkt de navigatie op onze blog, legt geen verband tussen de informatie die de cookies automatisch optekenen en de nominatieve gegevens van onze bezoekers.

JPCR nv informeert de gebruikers hierover conform de vigerende wetgeving.

2.7 Ingezamelde gegevens en verduidelijking van de doeleinden

JPCR nv zamelt uw persoonsgegevens enkel in wanneer u ze vrijwillig meedeelt en in toepassing van dit privacybeleid. De ingezamelde gegevens zijn deze die we kregen tijdens het selectiegesprek en deze die u bij uw deelname aan een willekeurige studie via de blog meedeelt.

De gegevens die we inzamelen wanneer u zich op onze blog inschrijft, zijn enkel deze die nodig zijn voor de verwerking van uw gegevens in overeenstemming met het doeleinde waarvoor u ze ons hebt toevertrouwd. We vragen u geen “gevoelige” gegevens (in de zin van de Belgische regelgeving) en deze worden ook niet ingezameld via andere gegevensbestanden, behalve in het uitzonderlijke geval van een marktstudie van bijvoorbeeld farmaceutische producten en steeds met uw voorafgaande uitdrukkelijke instemming.

U wordt uitgenodigd om een formulier in te vullen waarvan sommige velden die vetgedrukt zijn of eventueel worden gevolgd door een asterisk (*) nodig zijn om de gevraagde dienst te verlenen en anderen optioneel zijn. Deze laatste moeten ons enkel toelaten om snel contact op te nemen indien dat nodig zou zijn of om uw verbruikersprofiel zo goed mogelijk te identificeren in het kader van de marktstudie die we voor onze klant organiseren en waarvoor u werd geselecteerd aan de hand van antwoorden op de blog.

De mededeling van uw postadres betekent dat u instemt met het ontvangen van brieven van ons. Indien u dergelijke brieven niet meer wenst te ontvangen, kan u ons bereiken op het adres onder punt 1 hoger.

De mededeling van uw telefoon- of gsm-nummer betekent dat u instemt met het ontvangen van een telefonische oproep van ons. Indien u dergelijke telefonischeoproepen niet meer wenst te ontvangen, kan u ons bereiken op het adres onder punt 1 hoger.

De mededeling van uw e-mailadres betekent dat u instemt met het ontvangen van e-mails van ons. Indien u dergelijke e-mails niet meer wenst te ontvangen, kan u ons bereiken op het adres onder punt 1 hoger.

We zamelen uw gegevens in voor volgende doeleinden:

Beheer van het bestand van de deelnemers aan een marktstudie voor een klant van JPCR nv;
Beheer van het consumentenpanel;
Keuze van de consumenten die op basis van hun profiel in aanmerking komen voor de studie;
Verwezenlijking van marktstudies;
Mededeling van de (geanonimiseerde) resultaten van de studie aan onze klant;
Archivering van de studies.

De persoonsgegevens die u ons hebt toevertrouwd, worden niet gebruikt voor direct marketing. We nemen contact op met u en vragen uw voorafgaande toestemming indien we u persoonsgegevens voor een nieuw doeleinde willen gebruiken.

Onderhavig privacybeleid kan de rechten die JPCR nv zou kunnen hebben tegenover een willekeurige natuurlijke persoon uit hoofde van contracten of een andere wetgeving, niet beperken.

2.8 Onthulling van gegevens aan derden

We onthullen uw persoonsgegevens niet aan derden. We houden ons enkel het recht voor om de persoonsgegevens mee te delen op verzoek van een gerechtelijke of administratieve overheid krachtens de wet.

Onze klant heeft toegang tot de antwoorden en commentaar op de blog, maar de persoonsgegevens van de auteurs van de antwoorden en de commentaar zullen nooit toegankelijk zijn voor hem.

2.9 Bewaringstermijn van de gegevens

De ingezamelde gegevens worden enkel voor de duur van de marktstudie bewaard en voor de bewaringstermijn na afloop van de marktstudie die door wettelijke of contractuele verplichtingen wordt opgelegd.

Bij gebrek aan wettelijke verplichtingen worden de gegevens van de deelnemers bewaard gedurende een periode van 10 jaar na hun laatste deelname aan een marktstudie of van 10 jaar na hun inschrijving indien ze nooit aan een studie hebben deelgenomen.

2.10 Vertrouwelijkheid en veiligheid

JPCR nv biedt de bezoekers van de blog niet de mogelijkheid om een beveiligde communicatiemethode te gebruiken voor de verzending van de persoonsgegevens.

De blog voldoet aan een beleid, aan regels en veiligheidsmaatregelen die de persoonsgegevens moeten beschermen.

Rekening houdend met de meest recente technieken en de kosten voor hun toepassing, past JPCR nv de gepaste technische en organisatorische maatregelen en procedures toe, zowel bij de definitie van de verwerkingsmiddelen als bij de bewerking zelf, om ervoor te zorgen dat de verwerking voldoet aan de wettelijke voorschriften en de bescherming van de rechten van de betrokken persoon waarborgt.

JPCR nv voert alle mechanismen in om ervoor te zorgen dat standaard enkel de persoonsgegevens die nodig zijn voor elk specifiek doeleinde van de verwerking worden verwerkt. Deze gegevens worden meer bepaald niet langer ingezameld of bewaard dan de minimumtijd die nodig is voor deze doeleinden, wat zowel de hoeveelheid gegevens als de duur van hun bewaring betreft. Deze mechanismen garanderen meer bepaald dat persoonsgegevens standaard niet toegankelijk worden gemaakt voor een onbepaald aantal natuurlijke personen.

JPCR nv en elke onderaannemer voeren de gepaste technische en organisatorische maatregelen in om, rekening houdend met de meest recente technieken en de kosten voor hun toepassing, een veiligheidsniveau te garanderen dat aangepast is aan de risico’s van de verwerking en aan de aard van de te beschermen persoonsgegevens.

Na een risico-evaluatie nemen JPCR nv en de onderaannemer de maatregelen die de regelgeving voorziet om de persoonsgegevens te beschermen tegen toevallige of ongeoorloofde vernietiging en het toevallig verlies en om elke niet toegelaten verwerking te voorkomen, meer bepaald de onthulling, de verspreiding of de toegang zonder toelating, of de wijziging van de persoonsgegevens.

JPCR nv zal

er nauwlettend over waken dat de gegevens worden bijgewerkt, dat de onjuiste, onvolledige en niet ter zake dienende gegevens worden verbeterd of verwijderd;
ervoor zorgen dat de toegang tot de gegevens en de verwerkingsmogelijkheden voor de personen die onder zijn gezag handelen, beperkt blijven tot hetgeen die personen nodig hebben voor de uitoefening van hun taken of tot hetgeen noodzakelijk is voor de behoeften van de dienst;
alle personen die onder zijn gezag handelen, kennisgeven van de bepalingen van deze wet en haar uitvoeringsbesluiten, alsmede van alle relevante voorschriften inzake de bescherming van de persoonlijke levenssfeer die bij het verwerken van persoonsgegevens gelden;
zich ervan vergewissen of programma's voor de geautomatiseerde verwerking van persoonsgegevens in overeenstemming zijn met de vermeldingen van de aangifte aan de Commissie voor de bescherming van de persoonlijke levenssfeer en dat er geen wederrechtelijk gebruik van wordt gemaakt;
zich ervan vergewissen dat eenieder die handelt onder het gezag van de verantwoordelijke voor de verwerking of van de onderaannemer alsmede de onderaannemer zelf, die toegang heeft tot persoonsgegevens, deze slechts in opdracht van de verantwoordelijke voor de verwerking verwerkt, behoudens op grond van een verplichting door of krachtens een wet, een decreet of een ordonnantie;
treft en verplicht zijn onderaannemers en partners om de gepaste technische en organisatorische maatregelen te treffen die nodig zijn voor de bescherming van de persoonsgegevens tegen toevallige of ongeoorloofde vernietiging, tegen toevallig verlies, evenals tegen de wijziging van of de toegang tot, en iedere andere niet toegelaten verwerking van persoonsgegevens. Deze maatregelen moeten een passend beveiligingsniveau verzekeren, rekening houdend, enerzijds met de stand van de techniek ter zake en de kosten voor het toepassen van de maatregelen en, anderzijds met de aard van de te beveiligen gegevens en de potentiële risico's.

Indien de gegevensverwerking aan een onderaannemer wordt toevertrouwd, moet JPCR nv:

een onderaannemer kiezen die voldoende waarborgen biedt ten aanzien van de technische en organisatorische beveiligingsmaatregelen met betrekking tot de te verrichten verwerking;
toezien op de naleving van die maatregelen, met name door ze vast te leggen in contractuele bepalingen;
de aansprakelijkheid van de onderaannemer ten aanzien van de verantwoordelijke voor de verwerking vaststellen in de overeenkomst;
met de onderaannemer overeenkomen dat de onderaannemer slechts handelt in opdracht van de verantwoordelijke voor de verwerking en dat de onderaannemer is gebonden door dezelfde verplichtingen als deze waartoe de verantwoordelijke in toepassing van de wet is gehouden;
in een geschrift of op een elektronische drager de elementen van de overeenkomst met betrekking tot de bescherming van de gegevens en de eisen met betrekking tot de veiligheidsmaatregelen vaststellen;

2.11 Uw rechten als gebruiker

1.7 Assignment of intellectual property rights

The user hereby completely, irrevocably and exclusively assigns all the industrial or intellectual property rights, copyright and related rights in the works, preparatory work, studies, research, experiences, inventions, data feedback, answers to questions or others (hereinafter “the work”) carried out or performed as part or in the context of market studies, whether alone or in collaboration with others, as of the time these rights are secured, and this in the most comprehensive way, on any and all digital and other media JPCR SA may use as is or integrated, modified or otherwise, in whatever form or by whatever means, for the lifetime of the right concerned and on a worldwide basis.

The assigned rights are: the reproduction rights on any medium, the representation and public communication rights, the broadcasting rights whether directly or by satellite, via the Internet, cable, radio-relay system, or by any other technology, including the right of correction, assessment, follow-up, use, maintenance, adaptation, translation, commercialisation, publication, transcription, exploitation and development.

The user undertakes to provide JPCR SA with all the assistance it may need to obtain and retain any rights in or legal title to the work, object of the assignment, inter alia by signing all relevant documents and participating in any procedures to obtain said rights or titles.

The user guarantees that he holds all the copyright and related rights in the work protected by intellectual property legislation he may produce in the context of these presents and guarantees JPCR SA the full and free enjoyment of the assigned rights against any disturbance or exclusion. In the context of the Blog, the user is not permitted to use any protected work neither the user nor JPCR SA holds the proprietary rights in or to use protected work he did not acquire the rights in favour of JPCR SA to without notifying the latter beforehand and having obtained its express consent.

Only JPCR SA and its client are entitled to decide if, when, and how the work will be used. Also work that is not used shall remain the exclusive property of JPCR SA.

Right of the user: JPCR SA is authorised not to disclose the name of the user, to use work its author does not consider finished, and to modify the work in any way it deems necessary to show the work, without prejudice to the right of the user to object to any alteration, mutilation, modification or derogatory action in relation to the work which would be prejudicial to its author’s honour or reputation.

This assignment is governed by the Belgian intellectual and industrial property legislation. It is irrevocable. By virtue of said assignment, the user forfeits any and all rights in the elements assigned, in Belgium and abroad.

1.8 Right of image

The user hereby authorises JPCR SA to use, reproduce and communicate still images and/or video footage the user may post on the Blog (hereinafter the “Images”) either of the user him/herself and/or of other natural persons whom the user obtained written permission, identical to the present paragraph, , either in full or in part, whether integrated with other still or animated images or not, modified, airbrushed or otherwise, printed on paper, textiles, plastics or other materials, distributed via digital video or otherwise, and integrated with any electronic medium, Internet and intranet included, and this indefinitely as of the signing of the present authorisation.

This authorisation is granted for all broadcasting zones in Belgium and abroad and in respect of all internal and external communications, whether in favour of JPCR SA or its clients, and inter alia (but not limited to) internal company literature, institutional brochures or annual reports.
For any and all advertising purposes (giving rise to the purchase of advertising space on any external media or on any advertising or commercial media, packaging, publication, press, design, direct marketing, etc.) created by JPCR SA or its clients.

This authorisation is valid for a period of 5 years as of the date of the acceptance of the present document and may be extended. For the purposes of this authorisation, JPCR SA undertakes to comply with the data protection legislation. The JPCR SA privacy policy is set forth below.

The user hereby expressly waives any form of consideration in return for the use of the Images for the purposes set out in the present authorisation. The user confirms that he holds all the assigned rights, including all the relevant third-party authorisations, and understands and accepts that the present authorisation does not in any way oblige JPCR SA to use the Images.

The present authorisation can only be withdrawn on the basis of a request from the user, sent by registered post. The withdrawal of consent shall in any case at the earliest take effect 6 months after the letter was received and shall not apply to the use of Images on media in existence or in the pipeline on the date the letter is received and this for the entire useful life of the media in question.

1.9 User responsibilities

By accessing the information published on the site and by taking part in market studies, the user waives any and all claims and recourse of any kind against JPCR SA with regard to the use that is made of the data or information available on the Blog. JPCR SA shall not be held liable for damage of whatever nature, whether consequential or incidental.

Similarly, by accessing the information offered by the Blog, the user accepts that he bears full responsibility for the risks inherent to the use thereof and hereby waives any right of claim against JPCR SA, including for damage to a computer, software or data caused by a virus that may be transmitted or activated by the Blog or by virtue of the fact that the user accesses it.

Users may qualify for payment and/or expenses in consideration of their participation in studies offered by JPCR SA. In the cases stipulated by the tax and social legislation, users are obliged to declare this income in their tax returns and, where necessary, to take up the relevant tax and/or social status. Users working in the capacity of a self-employed person or operating as a company shall notify JPCR SA accordingly before taking part in the studies.

Users shall note and, in consequence of their acceptance of the terms of business, expressly accept that JPCR SA shall declare any payments it makes to users in the tax and social security returns imposed by law.

1.10 Security of the site

JPCR SA is free to take any measures it deems necessary to ensure the security of its website, such as security audits, encryption techniques, secure environments and any reasonable measures and procedures consistent with the state of the art in the field. Certain sections of the Blog may be reserved and subject to access procedures. If the site is hacked, falls victim to cybercrime or becomes the object of any unauthorised attempt to access the site or part thereof, JPCR SA shall resort to any legal means at its disposal to preserve the integrity of its Blog and this in collaboration with the competent judicial and police authorities.

1.11 – Applicable law and competent courts

As your visit to the Blog implies that you have agreed to these terms of use and, hence, that you have concluded an agreement online, you accept that any dispute or claim relating to the present Blog or any piece of information featured thereon are governed by Belgian law. You are free to access our home page and to consult our Blog without providing us with your personal data.

By using our Blog or signing up to our consumer panel, you explicitly declare to accept the Blog’s privacy policy and to agree to us collecting and processing your personal data in accordance with the terms and principles described in this policy.

2.3 Services and interactivity of our Blog

Our Blog, which, for certain studies, will be reserved for authorised users only, allows visitors to interact with one another and to publish information that is accessible to other Internet users.

2.4 Register of processing operations

JPCR SA keeps a record of all the processing operations performed under its responsibility. This documentation shall as a minimum contain the following information:

the name and details of the data controller, or of any joint data controller or of any processor, and of the representative, as the case may be;

JPCR SA informs users on their use in accordance with the prevailing legislation.

2.7 Data collected and specification of purposes

JPCR SA only collects personal data you provide of your own accord and in accordance with the present privacy policy. The data we collect are those we obtained during our interviews and any other data you provide us with when you take part in a study via the Blog.

The only data we collect when you subscribe to our Blog are those that are required to process the data relevant to the purpose for which you supplied them. You will not be asked for any “sensitive” data (within the meaning of the Belgian legislation), nor will any sensitive data be collected via other databases, save in the exceptional case of a market study relating to pharmaceutical products for instance and this subject to your explicit prior consent.

You will be asked to fill out a form containing a number of bold fields or fields marked with an asterisk (*), which are mandatory if you wish to be provided with the service requested, and a number of optional fields. The latter are purely intended to allow us to contact you quickly should this become necessary or to better identify your consumer profile in the context of a market study we are conducting on behalf of a client and which you have been selected to participate in via answers on the Blog.

If you provide us with your postal address, you agree to us contacting you by post. Please contact us as the address listed sub point 1 above if you no longer wish to receive post from us.

The purposes for which we collect your data are:

Managing the file of participants in market studies JPCR SA conducts on behalf of its clients;
Managing consumer panels;
Selecting consumers for studies on the basis of their profile;
Conducting market studies;
Transmitting the (anonymized) results of studies to our clients;
Archiving studies.

On no account shall any of your personal data be used for direct marketing purposes. We hereby undertake to contact you and ask you for your consent any time we wish to use your personal data for a new purpose.

The present privacy policy shall not in any way restrict the rights JPCR SA is bound by vis-à-vis natural persons, whether contractually or by law.

2.8 Disclosure of data to third parties

We do not disclose your personal data to third parties. We merely reserve the right to transmit personal data at the request of a judicial or administrative authority or on foot of the law.

While our clients do have access to the answers and comments on the Blog, they are never given access to the personal data of the authors of the answers or comments.

2.9 Length of data retention

The data collected are stored only for the duration of the market study and for the period of time we are contractually or by law obliged to retain them.

In the absence of any legal obligations, participants’ personal data shall be retained for a period of 10 years after they last took part in a market study or for ten years after they initially signed up if they never took part in a study.

2.10 Confidentiality and security

JPCR SA does not offer Blog visitors a secure method to transmit personal data.

The Blog is subject to a security policy, to security rules and measures designed to protect personal data.

Having regard to the state of the art and the cost of their implementation, JPCR SA applies, when defining the processing methods and during the actual processing itself, the appropriate technical and organisational measures and procedures to ensure that processing is consistent with the legal requirements and that data subjects’ rights are safeguarded.

JPCR SA has put mechanisms in place to ensure that, by default, only personal data that are required for each specific processing purpose are processed and, in particular, that their collection or retention does not go beyond what is necessary for these purposes, whether in terms of data quantity or the period of time they are stored. In particular, these mechanisms guarantee, by default, that personal data are not made accessible to an indefinite number of natural persons.

Having regard to the state of the art and the cost of their implementation, JPCR SA and its data processors have implemented the appropriate organisational and technical measures to ensure a level of security commensurate with the risks represented by the processing and the nature of the personal data to be protected.

On the basis of a risk assessment, JPCR SA and its data processor take the measures prescribed by law to protect personal data against accidental or unlawful destruction and accidental loss and to prevent any form of unlawful processing, including the unauthorised disclosure, distribution or access and the alteration of personal data.

JPCR SA shall

make every effort to ensure that the data are up to date, to correct or delete any data that are incorrect, incomplete or irrelevant;
see to it that access to and the opportunities to process data are limited to what any persons acting under its authority need to carry out their duties or to the requirements of the service;
inform any persons acting under its authority of the provisions of Belgian law and its implementing decrees, and of any relevant provisions on privacy and the processing of personal data;
ensure that the software used for the automatic processing of personal data is in conformity with the terms of the declaration submitted to the Privacy Commission and is applied lawfully;
ensure that any persons acting under the authority of the data controller or a data processor, and the data processor personally, who have access to personal data, can only process data on the instructions of the data controller, unless compelled to do so by virtue of a law.

Where the processing of data is entrusted to a data processor, JPCR SA shall:

choose a data processor that provides the necessary guarantees in terms of the processing-related technical and organisational security measures;
ensure that these measures are adhered to, inter alia on the basis of specific contractual provisions;
contractually define the data processor’s responsibility vis-à-vis the data controller;
agree with the data processor that the latter shall act on the instructions of the data controller only and is bound by the exact same legal obligations as the data controller;
set out the data-protection elements of the contract and the relevant security requirements in writing or on an electronic medium;
